Terms and Conditions

1. License

These Terms of Service ("Terms") govern your use of Moonfrog's social games and related services, including Teen Patti Gold, Rummy Gold, Poker Gold, applications for mobile devices and Moonfrog branded websites (the "Service"). "Moonfrog" means Moonfrog Labs Pvt. Ltd., located at 16/3, Level -3, Adarsh Yellavarthy Centre Cambridge Road, Ulsoor, Bangalore 560008, India, including its affiliates.

Use of the Service is also governed by Moonfrog's Privacy Policy. By creating an account or accessing the Service, you accept these Terms and consent to the collection, use and storage of your information as outlined in the Privacy Policy.

Moonfrog reserves the right to change, modify, add or remove portions of these Terms at any time. You will be deemed to have accepted changes by continuing to use the Service. If you do not agree to any portion of the Terms, your license to use the Service shall immediately terminate.

Subject to your compliance with these Terms, Moonfrog grants you a non-exclusive, non-transferable, revocable limited license to access and use the Service for your own non-commercial entertainment purposes.

1.1 Virtual Items

You may "earn," "buy" or "purchase" virtual currency and virtual in-game items ("Virtual Items"). You do not in fact "own" Virtual Items; they do not refer to any credit balance of real currency. You purchase a limited license to use the Service. Any "virtual currency" balance shown in your Account does not constitute a real-world balance or stored value.

1.2 Use of the Service – Virtual Chips Disclaimer

IN TEEN PATTI GOLD, RUMMY GOLD, POKER GOLD AND OTHER CARD GAMES, YOU MAY WIN OR LOSE VIRTUAL CHIPS. THESE VIRTUAL CHIPS HAVE NO REAL CASH VALUE AND CANNOT BE ENCASHED FOR ANY PRIZE, WINNINGS, REWARD, OR REAL MONEY VALUE WHATSOEVER. PARTICIPATION IS COMPLETELY FREE. THESE GAMES DO NOT OFFER REAL MONEY GAMBLING, WAGERING, BETTING, OR ANY OPPORTUNITY TO WIN REAL MONEY OR PRIZES. ANY SUCCESS IN SOCIAL CASINO GAMING IS NOT INDICATIVE OF FUTURE SUCCESS AT REAL MONEY GAMBLING.

The Service is intended for entertainment purposes only and does not promote gambling, wagering or betting. You must comply with applicable law in your jurisdiction. Moonfrog is not responsible for any betting, wagering or gambling outside these Terms.

1.3 Restrictions

You shall not:

Create an Account if you are under 13 (or the age specified on Google Play, App Store, or Facebook)
Have more than one Account per platform or SNS
Use cheats, exploits, bots, hacks or unauthorized third-party software
Post abusive, threatening, obscene or infringing content
Use the Service for commercial purposes without Moonfrog's written consent
Sell, trade or transfer Virtual Items or Accounts outside the Service
Reverse engineer, decompile or derive source code from the Service

1.4 Account Termination

Moonfrog may limit, suspend, terminate or delete Accounts or access to the Service if you fail to comply with these Terms or for any illegal or improper use. You may lose your username, benefits and Virtual Items. Moonfrog is under no obligation to compensate you. You may cancel your Account by emailing [email protected].

2. Fees and Purchases

You may purchase a license to use Virtual Items with real money or by redeeming third-party virtual currency. PURCHASES ARE NON-REFUNDABLE. Moonfrog is not required to provide a refund, and you will not receive money or compensation for unused Virtual Items when an Account is closed.

3. User Content

You are responsible for all User Content you post. Moonfrog has no obligation to monitor User Content but may edit, refuse to post or remove any content. By using the Service, you grant Moonfrog a perpetual, worldwide license to use your User Content in connection with the Service.

4. Intellectual Property Rights

Moonfrog / Teen Patti Gold do not infringe any copyrights.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Sites by completing the following Notice of Alleged Infringement and delivering it to Moonfrog's registered address. Upon receipt of the Notice as described below, Moonfrog will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Sites.

4.1 Notice of Alleged Infringement ("Notice")

Identify the copyrighted work that you claim has been infringed, or - if multiple copyrighted works are covered by this Notice - you may provide a representative list of the copyrighted works that you claim have been infringed.
Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including at a minimum, if applicable, the URL of the link shown on the Site(s) where such material may be found.
Provide your mailing address, telephone number, and, if available, email address.
Include both of the following statements in the body of the Notice: "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)." and "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
Provide your full legal name and your electronic or physical signature.
Deliver this Notice, with all items completed, to Moonfrog's registered address.

5. Disclaimer and Limitation of Liabilities

MOONFROG SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, EVEN IF MOONFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MOONFROG SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE SERVICES OR YOUR INABILITY TO ACCESS OR USE THE SERVICES; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY THIRD PARTY PROVIDER, EVEN IF MOONFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MOONFROG SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND MOONFROG'S REASONABLE CONTROL. YOU ACKNOWLEDGE THAT THIRD PARTY SERVICE PROVIDERS PROVIDING SERVICES REQUESTED THROUGH THEM MAY OFFER SERVICES AND MAY NOT BE PROFESSIONALLY LICENSED OR PERMITTED. IN NO EVENT SHALL MOONFROG'S TOTAL LIABILITY TO YOU IN CONNECTION WITH THE SERVICES FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION EXCEED FIVE HUNDRED RUPEES (INR 500).

THE LIMITATIONS AND DISCLAIMER IN THIS SECTION DO NOT PURPORT TO LIMIT LIABILITY OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." MOONFROG DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, MOONFROG MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE REGARDING THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY OR AVAILABILITY OF THE SERVICES OR ANY SERVICES OR GOODS REQUESTED THROUGH THE USE OF THE SERVICES, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. MOONFROG DOES NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY OR ABILITY OF THIRD PARTY PROVIDERS. YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE SERVICES, AND ANY SERVICE OR GOOD REQUESTED IN CONNECTION THEREWITH, REMAINS SOLELY WITH YOU, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.

6. Third Party Services and Content

The Services may be made available or accessed in connection with third party services and content (including advertising) that Moonfrog / Teen Patti Gold does not control. You acknowledge that different terms of use and privacy policies may apply to your use of such third party services and content. Moonfrog / Teen Patti Gold does not endorse such third party services and content and in no event shall Moonfrog / Teen Patti Gold be responsible or liable for any products or services of such third party providers. Additionally, Apple Inc., Google, Inc. and/or their applicable international subsidiaries and affiliates will be third-party beneficiaries to this contract if you access the Services using Applications developed for Apple iOS, Android powered mobile devices, respectively. These third party beneficiaries are not parties to this contract and are not responsible for the provision or support of the Services in any manner. Your access to the Services using these devices is subject to terms set forth in the applicable third party beneficiary's terms of service.

7. Dispute Resolution

This Agreement and any dispute arising from it or the Service shall be governed by the laws indicated below. For users in India: Moonfrog Labs (India) Pvt. Ltd., governed by Indian law, courts in Bangalore. For Rest of World: Moonfrog Labs (Asia) Pvt. Ltd., governed by Singapore law, courts in Singapore.

Before resorting to legal action, contact Customer Support. Moonfrog will consider reasonable requests for alternative dispute resolution such as mediation or arbitration.

8. Indemnification

You agree to indemnify and hold Moonfrog, its affiliates, contractors, employees and agents harmless from any claims, losses, damages and liabilities arising from your use or misuse of the Service, any violation of these Terms, or any breach of your representations and warranties herein.

9. Notices

Notices to you may be given via posting on www.moonfroglabs.com or via email. Notices from you shall be in writing and addressed to: Moonfrog Labs Pvt. Ltd., Attn: LEGAL DEPARTMENT, 18/6, First Floor, Cambridge Road 2nd Cross, Ulsoor, Bangalore 560008, India.
